About Topamax Lawsuits

Topamax is a pharmaceutical drug, also known as Topiramate. The drug is used to prevent and control epilepsy. This medication is also used to treat migraine headaches and decrease how often you get them. Pregnant women using the antiseizure drug pass on Topiramate into breastfeeding milk. As a byproduct, some children prenatally exposed to Topamax were born with a birth defect or an intellectual disability. Jama Neurology, a peer-reviewed medical journal published by the American Medical Association concluded that the usage of antiseizure medication increased the risk of autism spectrum disorders and intellectual disability by 2 to 4-fold. Despite the evidence showcased in medical studies, Topamax failed to create awareness among mothers and doctors regarding such risk.

SIGNS & SYMPTOMS

Topamax is associated with intellectual disability and birth defects. One of the most serious side effects of any medication. Reconstructive surgery to treat a birth defect can cause pain and suffering, permanent disfigurement, costly medical expenses, and birth trauma for the mother. There is no excuse for drug-makers who fail to warn about these risks. Side effects and Health Conditions include, but are not limited to::

  • A change in the way foods taste
  • Abnormal vision
  • Decreased feeling or sensitivity, especially in the skin
  • Diarrhea
  • Difficulty with memory
  • Dizziness
  • Fever
  • Nausea
  • Nervousness
  • Not feeling hungry
  • Pain in the abdomen
  • Sleepiness/drowsiness
  • Slow reactions
  • Speech problems
  • Tingling of the arms and legs (paresthesia)
  • Tiredness
  • Upper respiratory tract infection
  • Weight loss

TAKE ACTION

The U.S Department of Justice announced in the past that Ortho-McNeil-Janssen Pharmaceuticals falsely advertised to consumers by promoting that Topamax could treat other illnesses beyond Epilepsy. This led to incorrect information being submitted to the government health care programs. It was said the company will potentially pay more than $75 million to settle civil fines given that it violated the False Claims Act.

The other subsidiary, Ortho-McNeil Pharmaceutical LLC presumably hired outside physicians to join sales reps on sales calls and events to push Topamax while promoting the drug for off-label uses.

Johnson & Johnson subsidiaries failed to make consumers aware of the birth defects risks the product may cause. There is no excuse for such negligence and lack of transparency. The injured party shouldn’t suffer in silence. If you or a loved one have used Topamax products and had complications with your pregnancy.
