NY State Sex Abuse – What is the Adult survivors act (ASA)?

Sexual abuse occurs when there is undesired sexual behavior by one person upon another, this is also referred to as molestation. It often happens by taking advantage of or using force on another. When force is of short duration or immediate, or infrequent it is called sexual assault. Many factors prevent sexual abuse victims from stepping forward to denounce the molester or sexual offender. One of these factors could be the victim feels the shame of a possible negative response from peers. Now a victim has a renewed opportunity to take legal action against the person who committed the sexual assault as well as the person’s employer when those facts apply. This is all possible in the state of New York thanks to the new legislation (Adult Survivors Act) signed into law by Governor Kathy Hochul.

Signs of Abuse

Sexual assault victims often experience feelings of shame and anxiety. The long-term effects may include depression, substance abuse, sleep disturbances, eating disorders, and problems in romantic and sexual relationships. The victim can ruminate about the abuse later, causing them panic attacks. This form of trauma is known as a post-traumatic stress disorder, which is triggered by a terrifying event. It is suggested that the abuse victim to seek counsel to help recover. Other signs that may indicate abuse has occurred include, but are not limited to:

  • Amnesia
  • Brain damage from stress hormones
  • Dissociation
  • Dyspareunia
  • Flashbacks
  • Gastrointestinal disorders
  • Mood Swings
  • Nonspecific vaginitis
  • Paranoia
  • Pelvic pain
  • Phobias
  • Self-isolation
  • Sense of Helplessness
  • Suicide
  • Vaginismus
  • Paranoia
  • Withdrawal/Isolation

TAKE ACTION

Healing from sexual abuse doesn’t happen overnight, and its long-term effects could affect some victims for years. As a result, the Adult Survivors Act was enacted which allows a one-year window for survivors of adult sexual abuse in New York to file a lawsuit against their abuser. This extends the statute of limitations for the sexually abused victim who wishes to bring their molesters to justice for their heinous acts. The new ASA filing window will last from November 2022 to November 2023 and victims of sexual abuse are suggested to seek legal assistance.

For a limited time, this new law provides a “revival window” for victims to go back to any point in their lives, no matter how many years ago it occurred, and bring a potential legal case now. If you or a loved one have suffered sexual abuse from a molester, you may be eligible to file a lawsuit.
